Preparing and conducting a tender for a comprehensive supply of natural gas

Preparing and conducting a tender process for an natural gas supplier consists in developing documentation required by the public procurement procedure based on the Public Procurement Law, and providing advisory services during the proceedings. Having the tender and contract documents prepared, it is also possible to conduct proceedings on behalf of the Ordering Party.

The following documents are developed when preparing a tender for an natural gas supplier:

  • terms of reference, including prerequisites and the criteria for evaluation of offers;
  • detailed description of the subject of the order;
  • the price form and the offer form;
  • templates of declarations submitted by contractors;
  • natural gas supply agreement template construed in accordance with the provisions of the Public Procurement Law, the Energy Law and the Civil Code;
  • estimated value of the order.

As part of the preparation work, and before any tender is advertised, analysis of natural gas prices on the market is performed, the purpose of which is to choose the right moment of lauching the tender process and opening the bids.

We anticipate the following forms of cooperation in conducting a tender process for an natural gas supplier:

1. Provision of consultancy services during the proceedings, i.e.

  • support in the preparation of an invitation to tender;
  • support in preparing responses to contractors’ inquiries;
  • necessary modification of the tender documents;
  • participation in the works of the tender committee;
  • bids evaluation based on their formal, technical and financial merits;
  • developing suggested award procedure, including exclusion of bidders and rejection of bids or cancellation of proceedings.

2. Conducting the proceedings on behalf of the Ordering Party, i.e. 

  • preparing an invitation to a tender and either placing it in the Public Procurement Bulletin or sending to the Publications Office of the European Union on behalf of the Ordering Party;
  • responding to contractors’ inquiries;
  • necessary modifications to the tender documents;
  • appointment of a tender committee or participation in the works of the tender committee;
  • bids evaluation based on their formal, technical and financial merits;
  • awarding the contract, including exclusion of bidders and rejection of bids or cancellation of proceedings.

As a result the best offer is selected, taking into account the criteria for bids evaluation specified in the tender terms of reference, and a contract is concluded between the Ordering Party and the selected natural gas supplier.

After the contract is awarded, we offer assistance in the area of:

  • preparation of the contract award notice,
  • preparation and placing the contract award notice in the Public Procurement Bulletin,
  • sending the contract award notice to the Publications Office of the European Union on behalf of the Ordering Party.
  • When required, we also provide necessary assistance in terminating of existing agreements or we conduct this process on behalf of the Ordering Party. The final step is monitoring of the process of changing a supplier.
